Membership and Account Terms and Conditions

Effective 5 April 2025

Introduction

This is an agreement between you (the “Member” or “you”) and Move.Fitness Club Limited (“Move.Fitness”, “we” or “us”).

We are a company registered in England and Wales with company number 15591629.  Our registered office address is 78 Loughborough Road, Quorn, Loughborough, England, LE12 8DX.

Together with our Website Terms of Use, our Privacy Policy, our Cookie Policy and our Gym Rules, these terms and conditions form the agreement between you and us.  When you complete the membership application process or register for an online account through the member area of our website, you agree to be bound by all the terms and conditions of this agreement.

The minimum age for membership and use of our website and gym is 16.

Move Open, Move Coached and Move Free Members are referred to as Move Members with Move Memberships where the terms and conditions are different for Move Members and Pay As You Go Pass Members.

If we stop providing a type of membership, we will let you know as soon as possible in advance and will give you the choice of either (a) refunding you for any amounts paid and ending your agreement at the date that we stop providing that membership, or, where available, (b) transferring your membership to another type of membership.

  1. Starting your agreement

If you are a Move Member, your agreement with us starts immediately on the date that you complete your online membership application.  The initial term of our agreement is twelve months, which renews as set out in section 5 below.

If you are a Pay As You Go Pass Member, your agreement with us starts immediately on the date that you book your first class with us.  Your Pay As You Go Pass Membership does not entitle you to use any facilities or equipment, nor to book any classes other than the specific day pass purchased.   

  1. Your health

Move.Fitness personnel are not medical professionals and nothing they say is a substitute for advice from a suitably qualified and regulated medical professional.  If you have any concerns about your health, or the suitability of using any equipment, joining any class or participating in any training or nutritional programme, you should take advice from a doctor or other appropriately regulated medical professional. 

We reserve the right to (but are not obliged to) require any Member or prospective Member to undergo a gym induction.  If required by a member of staff, you will sign a confirmation statement confirming (a) that you have completed an induction with qualified Move.Fitness staff on completion of the induction, or (b) you were offered an induction but declined it, or (c) you have provided evidence of relevant experience such that you do not require an induction.  In the case of (c) the confirmation statement must provide reasonable detail of the evidence provided.

Where we decide to limit your use of or access to equipment because we reasonably consider that it is unsuitable for you to use, you agree to comply with any conditions we place on your use of our equipment, facilities or services. 

If you are under the age of eighteen you are not permitted to use free weights in the gym before your eighteenth birthday.

On your first visit to our gym, you must fill out any necessary health and safety documentation before you can use any facilities or join any classes. 

  1. Payments

Move Members agree to pay the membership fee applicable to your membership on the date specified in the application process and then monthly starting one calendar month after your agreement starts.  You agree to maintain a Direct Debit instruction with your bank.  It is your responsibility to ensure that the payment details you provide to our payment provider are current and valid.  When you or your bank tell our payment provider about a change to your bank account details, we may ask you to agree a new Direct Debit mandate.

You must pay your membership fees whether or not you actually make use of the gym or any of our services. While you owe us any payment, we reserve the right to refuse access to our gym and wider site until your payments are made up to date.  If any payment remains outstanding for a month or more, we may cancel your membership at our discretion.

Pay As You Go Pass Members and Move Members booking classes not included in their membership must pay in full for all purchases at the time of booking. 

Membership fees are payable whether or not there is any temporary interruption in services during the applicable month and whether or not the circumstances of the interruption were foreseeable or unforeseeable.  From time to time we may have to cluse the gym or restrict access to a part of it, for example when it is necessary for cleaning, maintenance, repair or refurbishment works.  No deduction may be made and no refund will be due where we are required to close the gym, or restrict access to any part of the gym.  We will try to give you notice of any closure or restricted access, but this might not be always be possible, for example where there has been an emergency.

  1. Changes to Fees and Charges

We may increase membership fees at our discretion but will try to limit any increases to no more frequently than once in any twelve months.  We will not increase membership fees in the initial twelve-month term and we will notify you by email at least three weeks before any change to the Move Membership fees.  If you do not agree to the increased fees, you can cancel your membership within this three-week period, but if we don’t hear from you before the end of the three-week period, the new Move Membership fees will be applied to your subsequent payments.

If you want to upgrade your type of Move Membership, you can do so in person in the gym no later than seven days before the end of the current month of your membership.  You will be asked to confirm the new monthly payment amount which will be applied on your usual monthly membership renewal date.  Your new Move Membership type will start from that renewal date.

We may increase Pay As You Go Pass fees and class fees at any time but will try to limit any increases to no more frequently than once in any twelve months.

If the rate of VAT changes we will adjust the rate of VAT that you pay, except for payments you have already made in full before the change in the rate of VAT takes effect.

  1. Your rights to cancel your membership

You have the right to cancel this agreement within fourteen days from the start of the agreement without giving us any reason (the “cooling off period”).  You can do so by email to at [email protected] before the end of that cooling off period. If you cancel by email, we have the right to ask you to provide that the email was sent before the cancellation period.  Where you cannot prove that the email was sent before the end of the cooling off period, we do not have to agree to cancel your membership.

If you cancel during the cooling off period but after you have started to use the gym, any functional and strength programmes or limited access to premium first floor classes, we may charge you pro rata for the days you have used.

After the cooling-off period you may cancel your Move Membership in the following circumstances only:

  • you have a medical event or condition supported by written documentation from an appropriate medical professional stating that you should not take part in physical exercise for a period of at least twenty-eight days;
  • you provide us with evidence that you have moved house and now live over fifteen miles from our gym at 20 Newton Road, Heather, Coalville LE67 2RD;
  • you provide us with evidence that you have suffered a loss of earnings such that you can no longer honour your financial commitment due to a dramatic change in income.

You can also end your Move Membership agreement with us at the end of the initial twelve-month term (and any subsequent twelve-month renewal term) by providing us with at least thirty days’ notice before the end of that twelve-month term.  You can do this by emailing us at [email protected].  We will email you before the end of the initial twelve-month term to remind you of your right not to renew, but if you do not provide us with notice at least thirty days before the end of the initial twelve-month term, this agreement will automatically renew for a further twelve months. 

For classes booked and paid for in addition to your Move Membership, you will only receive a refund if you cancel at least seven days before the day of the class.  For blocks of classes, you will receive a refund for any classes that are more than seven days after the date of cancellation.  For courses, you will only receive a refund if you cancel at least seven days before the course starts.

  1. Our rights to cancel your membership

We may cancel Move Membership at any time on one months’ notice.  We may cancel Pay As You Go Passes or classes bought in addition to Move Membership at any time on seven days’ notice, or in case of illness or emergency, on such notice as is possible in the circumstances (if any).  We will refund any monthly fees already paid for any period after the end of the notice period.  We will cancel bookings for classes and refund the applicable fee where those classes fall after the applicable notice period. We will refund Pay As You Go Passes paid for and cancelled by us if you do not take up any option to change the day offered by us.

We may cancel your notice at any time without notice if:

  • we, in our absolute discretion, consider that you are not physically able to use any equipment, facilities or services safely; believe you may harm yourself or others by using equipment, facilities or services; or believe you are not medically fit to use our equipment or facilities; or
  • you seriously or repeatedly breach this agreement, the Gym Rules or Website Terms of Use;
  • your conduct puts our employees, other Members or visitors to our site at risk, or we reasonably believe that it may do so in future;
  • you don’t make any payment to us when it’s due and you still don’t make payment within five days of our reminding you that payment is due;
  • you permit any other person to use your membership in your place;
  • you do anything at our gym that competes with our services, whether offering to do so, doing so, advertising or promoting competing services;
  • you decline to complete any health and safety documentation or documentation required by our insurer.
  1. Our right to refuse applications for membership or classes

We are entitled to reject applications for Move Membership and Pay As You Go Pass Membership or refuse bookings at our discretion, whether or not you have been a Member before.  When this happens, we let you know as soon as possible and refund any sums you have paid.  We do not have to provide any reason for refusal of membership or other purchases.

  1. Lockers

Lockers are made available on a first come, first served basis.  You agree to only use a locker for the period of each visit to the gym and to empty it and leave it open, clean and dry for the next user before you leave.  If lockers remain in use after your visit or at the end of the day, we may open and empty them at any time without obtaining permission from you and without you being present.  We may dispose of items emptied from lockers after a reasonable period.

You will not store anything noxious, illegal or dangerous in the lockers. Please do not bring valuable items or large sums of money onto our site.

If you lose your key or damage a locker, you agree to pay the cost of replacing the lock and repairing any damage on demand.

  1. Audio recording, video recording and photographs

You agree that we may use any photographs or video images taken in the gym in any future media productions for promotional use.  We will also ask you for permission at the time if you are to appear centrally in photographs or video images, but may not do so if you are only in the background.

You agree that you will not make any audio or video recording, or take any photographs of any other person, anywhere on site.  If you take any photograph or video recording of yourself, you agree to comply with the Gym Rules relating to photography and video recording.

You must not use any AI or editing to negatively or falsely portray Move.Fitness or any of its employees, Members or visitors.  You acknowledge that Members, employees and guests are entitled to privacy and dignity both on site and elsewhere and agree not to create, post or share anything created in or depicting the gym that features any person other than you.

  1. Gym Rules

Our Gym Rules are displayed on notice boards, walls and doors at the gym.  In addition to these membership terms and conditions, you agree to the Gym Rules displayed, as amended from time to time.

  1. CCTV and Data Protection

How we use your personal data is set out in our Privacy Policy.  We operate CCTV on site and CCTV images are captured, processed and retained in accordance with our Privacy Policy.

  1. Our liability

We will not pay you compensation for loss or damage you may suffer unless it is caused by our negligence or failure to comply with an applicable law.

We will not pay you compensation if we have failed to carry out our duties due to something that is your own fault, or the fault of someone else who is not acting with authority from us.

We cannot accept any liability for theft or for loss or damage to your property unless that theft or loss or damage was caused by our negligence. It is your responsibility to ensure that your valuables are stored securely.  

Nothing in these terms and conditions excludes or limits our liability for:

  • death or personal injury caused by our negligence or that of our staff; or
  • fraud or fraudulent misrepresentation; or
  • any other liability which we cannot by law exclude or limit.

Subject only to the paragraph immediately above, our total liability to you for any one event or series of related events shall in no event exceed an amount equal to six months’ membership fees at your usual monthly payment for Move Members, of for Pay As You Go Members, an amount equal to six months’ membership fees at the lowest Move Membership monthly payment at the time.

  1. Parking

Where we make any parking area available for use by Members, it is on a first come, first served basis.

When using the car park, Members agree to the terms and conditions displayed on signs in the car park

  1. Changes to these terms and conditions

We may make reasonable changes to these terms and conditions from time to time.  We will try, but are not obliged, to provide you with notice of any changes by email.

  1. Events beyond our control

If we are unable to provide all, or substantially all, of our gym services for thirty consecutive days or more, for reasons or events beyond our reasonable control, you or we can cancel your agreement immediately by written notice.

  1. Assignment

This agreement is personal to you and the benefit of this agreement may not be assigned by you to any other person.

We can transfer our agreement with you, so that a different organisation is responsible for supplying your service.  We’ll tell you in writing if this happens and we’ll ensure that the transfer won’t affect your rights under the contract.

  1. Rights of third parties

This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

  1. Invalidated terms

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

  1. Delays in enforcing terms

Even if we delay in enforcing this contract, we can still enforce it later. If we don’t immediately chase you for not doing something (like paying) or for doing something you’re not allowed to, we are not prevented from doing it at a later time.

  1. Governing law and jurisdiction

This agreement is governed by the laws of England and Wales.  Any disputes relating to your membership and/or this agreement which we are unable to resolve between us will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

We advise you to print a copy of this agreement for your records.
